SUBCOMMITTEE OF THE COMMITTEE ON

PRIVILEGES AND ELECTIONS,

The subcommittee met at 10 o'clock a. m., Senator Selden P.

Spencer presiding.

Present: Senators Spencer (chairman), Ernst, King, and Neely. Present on behalf of the contestant: Luther Nickels, Esq., and Scott Woodward, Esq.

Present on behalf of the contestee: W. F. Zumbrunn, Esq., and W. P. McLean, jr., Esq.

The CHAIRMAN. The subcommittee will come to order.

Mr. NICKELS. Mr. Chairman, I would like to have the witnesses sworn and put under the rule.

The CHAIRMAN. Do you want them separated?

Mr. NICKELS. I do not care to have them separated.

The CHAIRMAN. Do counsel on the other side want them separated?

Mr. ZUMBRUNN. I do not care.

The CHAIRMAN. There is no object in swearing them all together that you have in mind, is there?

Mr. NICKELS. Except that gentlemen on the other side invoked the rule, and there are certain witnesses here

Mr. McLEAN. He wants the witnesses to retire.

The CHAIRMAN. Very well.

The Chairman thereupon administered the oath to Mr. J. Q. Jett and Mr. N. N. Furney.

Mr. NICKELS. Mr. McQuinn, you have already been sworn?
Mr. J. E. McQUINN. Yes, Mr. Nickels.

Mr. NICKELS. I would like to have Mr. Furney retire. Mr. McQuinn also will retire.

(Thereupon the two gentlemen named retired from the room.)

TESTIMONY OF J. Q. JETT

(The witness had been previously sworn by the chairman.) Mr. NICKELS. Your name is J. Q. Jett?

Mr. JETT. Yes, sir.

Mr. NICKELS. Where do you live?

Mr. JETT. White Path, Ga.

Mr. NICKELS. Were you ever in the employment of the organization called the Knights of the Ku-Klux Klan, at Atlanta?
